$120K Settlement for Man Previously Accused of DUI Manslaughter

In May, a Vegas man was charged with a felony DUI after a wreck that caused the death of 28 year old police officer James Manor. 45 year old Calvin Darling was accused of DUI after he admitted that he had a few drinks at a bar before driving. The DUI charge was automatically a felony since it resulted in vehicular homicide. He was also charged with failure to yield to an emergency vehicle.
After being held for about a day and a half, Darling was released from Clark County Detention Center when authorities realized that his blood alcohol content (BAC), was .35%, which is less than half of the legal limit. The charges were not immediately dropped, however, as DUI charges do not necessarily require a .08% BAC if police determine that the driver was impaired.
The court hearings have been completed, and not only has Darling been acquitted of all charges, it was determined that Manor was driving at 109mph, did not have his lights or sirens on, and was not wearing a seat belt.
Darling has been offered a $120,000 settlement for the wrongful accusation.
