Driver Accused in DUI Vehicular Manslaughter Permitted to Return to Ukraine; Decides Against It

The man who in 2009 was accused of a DUI accident which resulted in the death of an 18 year old girl, Lindsay Bennett, was granted permission to visit his sick mother in the Ukraine. She is apparently ill with terminal cancer. Although many people protested the judge's ruling, claiming that the United States has no rights to extradite him from the Ukraine if he decided to stay, the judge allowed him to return to visit his mother before she passes.
The defendant, Vladimir Lagerev, has decided not to return home to see his mother one last time because, according to her doctor, the visit would further deteriorate her condition, and Lagerev does not want to do anything to worsen this time for her.
Lindsay Bennett was a freshman at UNLV, was a member of the Rebel dance team. Lagerev's blood alcohol content was .20 when the fatal wreck occurred. His hearing is set for February 2011 and he has been freed on a $100,000 bond since June of 2009.
